1. Acceptance of Terms
By creating an account or using Ortho Board Prep, you agree to these Terms of Service and our Privacy Policy. If you do not agree, you may not use our service. You must be at least 18 years old to use this service.
2. Description of Service
Ortho Board Prep is an educational platform designed to help orthopedic surgery professionals prepare for the American Board of Orthopaedic Surgery (ABOS) Part II oral examination. Our services include:
- Document management and organization for case preparation
- AI-powered document analysis and case summary generation
- Practice examination sessions with AI examiners
- Study materials and training resources
- PHI detection and redaction tools
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to:
- Provide accurate and complete registration information
- Maintain one account per person
- Not share your account credentials with others
- Notify us immediately of any unauthorized account access
4. Acceptable Use
You agree to use Ortho Board Prep only for lawful, educational purposes. You shall not:
- Share account credentials or allow unauthorized access
- Upload malicious content, viruses, or harmful code
- Attempt to reverse-engineer, hack, or exploit our AI systems
- Use automated scripts or bots to access the service
- Violate any applicable laws or regulations
- Infringe upon the rights of others
5. Intellectual Property
Your Content: You retain ownership of all documents, images, and materials you upload to Ortho Board Prep. By uploading content, you grant us a limited license to process, store, and analyze that content solely to provide our services to you.
Our Platform: Ortho Board Prep, including its design, features, AI models, and generated content structures, is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute our platform or its components.
6. Medical Disclaimer
Important Notice
Ortho Board Prep is an educational preparation tool only. It is NOT medical advice, NOT a substitute for professional medical judgment, and NOT affiliated with or endorsed by ABOS.
AI-generated content, including case summaries, practice session feedback, and study materials, may contain errors or inaccuracies. You are solely responsible for verifying all information and exercising independent professional judgment.
Success on the ABOS oral examination depends on many factors. We make no guarantees regarding examination outcomes.
7. Protected Health Information (PHI)
Ortho Board Prep provides tools to help you manage and redact Protected Health Information. However:
- You are responsible for ensuring proper authorization before uploading any PHI
- You must verify that redaction is complete and accurate before sharing documents
- Our AI detection tools are aids, not guarantees of complete PHI identification
- Please review our separate HIPAA Notice for more details
8. Limitation of Liability
To the maximum extent permitted by law, Ortho Board Prep and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:
- Loss of data or documents
- Errors in AI-generated content
- Examination outcomes
- Service interruptions or unavailability
- Unauthorized access to your account
Our total liability shall not exceed the amount you paid for the service in the twelve (12) months preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless Ortho Board Prep and its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the service, violation of these terms, or infringement of any third-party rights.
10. Termination
Either party may terminate this agreement at any time. You may delete your account through the account settings. We may suspend or terminate your access for violation of these terms or for any other reason with or without notice.
Upon termination, your right to use the service ceases immediately. We will delete your data in accordance with our Privacy Policy, typically within 30 days of account deletion.
11. Changes to Terms
We may update these Terms of Service from time to time. We will notify you of material changes by email or through the service. Your continued use after such notification constitutes acceptance of the updated terms.
12. Governing Law
These terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any disputes shall be resolved in the courts of California.
